PRESIDENT SIGNS LILLY LEDBETTER FAIR PAY ACT

On January 29, 2009, President Obama signed the Lilly Ledbetter Fair Pay Act of 2009 (LLFPA) into law. The legislation (SB 181) restores the EEOC’s longstanding position that pay discrimination is actionable under federal law, regardless of when the discrimination began.  Read more...

BILL PROVIDES FEDERAL SUBSIDY FOR COBRA PREMIUMS
 

On February 17, 2009, President Obama signed into law an economic stimulus bill that includes significant COBRA changes for employers. The American Recovery and Reinvestment Act of 2009 (ARRA), contains a temporary federal government subsidy to cover 65% of the cost of COBRA premiums for employees who were involuntarily terminated between September 1, 2008 and December 31, 2009.  Read more...

I-9 FORM DELAYED 

On Friday, January 30, the USCIS announced a 60-day delay in requiring the new I-9 Form. As mentioned in a previous Hot News article, a new version of the I-9 (revision date “Rev. 02/02/09 N”) was scheduled to go into effect on February 2, 2009. However, the USCIS has pushed back the effective date until April 3, 2009.  Read more...
 



EXECUTIVE ORDER ELIMINATES BECK NOTICE REQUIREMENT
 

On January 30, 2009, President Obama signed the “Notification of Employee Rights” Executive Order 13496, which specifically revokes a previous Executive Order and eliminates the “Beck” notice requirements. The Beck notice was a requirement under the Bush Administration that ordered federal contractors to post a notice advising employees of certain rights, such as the right not to join a union.  Read more...

PAYS 2.25 MILLION TO SETTLE HIPAA
PRIVACY CASE
 

The U.S. Department of Health and Human Services (HHS) and the Federal Trade Commission (FTC) have announced that CVS, the nation’s largest retail pharmacy chain, will pay the U.S. government a $2.25 million settlement and take corrective action to ensure it does not violate the privacy of its millions of patients when disposing of patient information such as identifying information on pill bottle labels.  Read more...

An interstate trucking firm has agreed to pay $2.43 million and provide other remedial relief to a class of women to settle a discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC). The EEOC had charged in the litigation that the company denied a class of qualified female applicants employment as truck drivers or dockworkers since 1997, while men were placed in these positions during the same period.  Read more...
